A suspended Schenectady city police officer is back behind bars after his sixth arrest in just two years.
John Lewis has been charged with DWI after allegedly driving drunk Saturday night and hitting a parked car outside the Ellis hospital emergency room.
Lewis is also charged with aggravated unlicensed operation and leaving the scene of an accident.
In the past, he has been charged with stalking his ex-wife.
A local attorney points out that Lewis has, so far, not been convicted of a felony and that plays a role in his possible termination.
“A police officer can’t just be fired on the spot,” says NEWS10 legal analyst Thomas Carr, of Tully, Rinckey PLLC. “There are certain administrative procedures to go though, separate and distinct from any criminal procedures that have to be gone through.”
A termination hearing for Lewis has been completed.
The police department is waiting for a decision from an arbitrator.
