ROCHESTER, N.Y. (WHEC) — A Rochester lawyer says the sudden eviction notices given to people living at Patty’s Lodge in Hopewell might not be legal.
Patty’s Lodge was the location of the investigation into the death of Sam Nordquist last year. The eviction notice residents showed News10NBC was dated Thursday, May 21, and gave them only 11 days to vacate.
Michael Macomber, a lawyer with Tully Rinckey PLLC, says that depending on how long someone has been living there, that might not be enough time.
“If they have been staying at the location long enough, they may have shifted or expanded their protections into that of a tenancy and generally if you are to be considered a tenant you have to get 30 days notice,” Macomber said.
“I think if people have been there since September or longer, that certainly weighs in favor of them being tenants,” Macomber said.
