The Hatch Act places clear prohibitions on federal employees engaging in political activity. By forwarding an email that includes a solicitation for funds for a partisan campaign, or by encouraging coworkers to attend a political fundraiser, for example, you could end up facing removal or suspension.

If you become subject to adverse actions by the Office of Special Counsel, the attorneys at Tully Rinckey PLLC in Washington, D.C., can advise you of your rights and aggressively represent you before the Merit Systems Protection Board. The MSPB may grant a more lenient penalty if the board unanimously decides removal is too severe.

If you face adverse action (suspension or termination) from the Transportation Security Administration (TSA) because of your conduct or performance, you have the right to appeal to the OPR Appellate Board (OAB). This is the only level of appeal available to you, so it’s critical that you understand your rights and present your appeal as strongly and succinctly as possible.

The skilled and experienced federal employment attorneys at Tully Rinckey PLLC can represent you in preparing and delivering your appeal. We understand the OAB’s unique appellate procedures and how best to present the facts and nuances of your case.

Mr. Green and his team worked diligently for months to conduct fact finding discoveries and resolve those facts with his client’s agency. He concluded his client’s ADR/EEO settlement agreement to reverse and rescind unlawful practices, acts, and future patterns against his client and offered his client alternative solutions for better career opportunities and a path forward acceptable by all major parties to the case. B.M. on Ryan Green, Esq.

“In January 2016 I experienced the worst discrimination and harassment by my supervisor I have ever seen in my 26+ years with the Federal Government. I requested the services of Tully Rinckey, PLLC. This is the second time attorneys with Tully Rinckey have provided exceptional legal advice. In this case, it was beyond my expectations how smoothly my EEO claim was handled and resolved in my favor. I was extremely distressed personally from January through June 2016 however my attorney, Allen A. Shoikhetbrod and the Legal Secretaries, Melissa Diabo and Peter Carley and associates showed compassion and professionalism that enabled me to follow through. I was always able to reach someone to help me particularly when I was feeling vulnerable and fearful that my unblemished federal career was in jeopardy. My attorney always gave me advice that was easy to understand and counseled me in such a way that gave me hope. I am now happy and relaxed for the first time in years. I hope I never need their services again but would recommend that if you need legal assistance, you would do no better than enlist the services of Tully Rinckey, PLL”

“I would like to thank Tully Rinckey PLLC and associate David Fallon for seeing my USERRA case to a successful conclusion. David immediately began the difficult task of reconciling over a decade of military and civilian finance and personnel records to determine a fair claim on my part. He is extremely knowledgeable and dedicated and worked tediously through a difficult negotiation with my former agency to resolve the case in my favor.”
