CLE – Defending DWI From the Roadside Through Discovery in New York State

Overview:

Enhance your DWI defense practice with this focused Continuing Legal Education (CLE) program presented by Derrick Hogan. Designed specifically for attorneys practicing in New York, this session provides a comprehensive, step-by-step analysis of defending driving while intoxicated cases—from the initial roadside stop through the discovery phase of litigation.

This CLE will examine the constitutional and statutory framework governing DWI enforcement, including the application of the Fourth Amendment to the United States Constitution and relevant provisions of New York Vehicle and Traffic Law. Participants will gain practical insight into how New York courts evaluate reasonable suspicion, probable cause, and the admissibility of evidence obtained during roadside investigations.

Derrick Hogan will guide attendees through effective strategies for challenging field sobriety tests, chemical test results, and police procedures. The program will also address discovery obligations under New York Criminal Procedure Law Article 245, including how to obtain and analyze critical materials such as body-worn camera footage, breathalyzer maintenance records, and laboratory documentation.

Through real-world scenarios and litigation-focused guidance, this CLE will highlight common evidentiary and procedural issues that can significantly impact case outcomes, equipping attorneys with the tools to identify weaknesses in the prosecution’s case and build a strong, strategic defense.

Overview:

Derrick Hogan is a Partner in Tully Rinckey PLLC’s Latham office, where he primarily focuses his practice on both federal labor and employment and criminal law. Derrick has experience in both federal and private employment law matters, handling cases involving discrimination and harassment in the workplace, disciplinary actions against federal employees, and representing federal employees who are under investigation.
