Overview of Employment Discrimination Laws in New York State

Overview:

Employment discrimination and retaliation claims are governed by complex federal and New York State legal standards, as well as specific procedural requirements that can significantly affect how these matters are brought, litigated, and resolved. This Continuing Legal Education (CLE) will provide attorneys with an overview of the substantive frameworks governing discrimination and retaliation claims, including key federal and New York State statutes, available remedies, and the procedural pathways for pursuing or defending against these cases across different forums. In this seminar, Amanda Smith, Esq. and Benjamin Westerman, Esq. provide attendees with a clear understanding of how these legal standards are applied in practice and how procedural requirements shape case strategy and outcomes.

Topics include:

Federal Laws:

  • Title VII;
  • Americans with Disabilities Act (ADA);
  • Age Discrimination in Employment Act (ADEA); and
  • Family and Medical Leave Act (FMLA).

New York State Laws:

  • New York State Human Rights Law; and
  • New York Labor Law Section 740.

  • Equal Employment Opportunity Commission (EEOC);
  • Department of Labor (DOL);
  • Occupational Safety and Health Administration (OSHA);
  • New York State Division of Human Rights; and
  • New York State Court.

To participate, please register using the form on this page. Upon registering, you will receive a link and instructions on how to access the CLE.  A timed agenda, supplemental course materials, an attorney affirmation and a course evaluation will be circulated on the day of the CLE.

After the CLE, please fill out and return the completed attorney affirmation and course evaluation to cle@tullylegal.com. Upon receipt, we will provide a certificate of CLE completion.

Benjamin joined Tully Rinckey PLLC in 2023 and focuses his practice on federal sector labor and employment and New York State employment law out of the Latham office. Benjamin represents clients in federal, state, and private employment law matters, including claims of discrimination, harassment, retaliation, whistleblower actions, and disciplinary matters
