Charges to be upgraded in Bentley’s DWI incident following victim’s death

SARATOGA COUNTY, N.Y. (WRGB) — Upgraded charges are expected to come for the suspect who pinned a Ballston Spa man under their car in a drunk driving incident, ultimately leading to the man’s death.

Among the charges against Morgan Lange was originally felony vehicular assault.

Legal experts say that the charge and others will likely be upgraded to vehicular manslaughter or homicide.

The case will now be presented to a grand jury and move forward from there.

The family attorney for Josh Soden, the victim, said they are planning to file a civil lawsuit against Bentley’s Tavern, likely for a wrongful death lawsuit.

“How much were they served? Did they drink anything non alcoholic? Did they consume any food? Did they have any form of incident?” Those are questions that would be identified in the lawsuit, said Aaron Pam, a Sr. Associate at Tully Rinckey PLLC. “Did the owners, managers, and bartenders, you know, take any type of steps or even attempt to take any type of steps to, you know, slow down serving or stop serving a customer?”

A GoFundMe page was created – it raised over 42 thousand dollars to help Josh’s family cover costs.
