New York DMV to enforce tougher traffic violation penalties: What drivers should know

ROCHESTER, N.Y. (WROC) — New York drivers could face tougher consequences for certain traffic violations later this month, as the state Department of Motor Vehicles rolls out a stricter point system aimed at repeat and high-risk offenders.

Under the changes, motorists may rack up more points for common violations than they previously would have — in some cases, more than for offenses like speeding or passing a stopped school bus.

“The penalties associated with traffic offenses are increased,” said Aaron Pam, a senior associate at Tully Rinckey PLLC.

One of the most significant changes is an expanded look-back period. Instead of reviewing violations over the past 18 months, the DMV will now consider a 24-month period when determining whether a driver has accumulated enough points for suspension.

Pam said the updated system lowers the threshold for losing driving privileges.

“It tends to target the worst drivers on the roads, who accumulate enough points to have their license suspended and the privilege to be a driver taken away sooner than good drivers,” Pam said.

Several common driving behaviors will now carry steeper penalties. Driving 10 miles per hour over the posted speed limit will result in four points instead of three. Using a cellphone while driving will remain at five points. Reckless driving will also carry five points. More serious offenses — including speeding through a construction zone, or passing a stopped school bus — can result in eight points.

Pam said the best way for drivers to avoid penalties is simple: follow the rules of the road.

“Drive safely and follow the rules of the road,” he said. “Try not to get pulled over and charged with traffic offenses. And when you do — because it happens to drivers on occasion — get good legal advice, go to court, tell the truth, and ask for mercy and leniency.”

The DMV’s updated point system is expected to take effect later this month.
