With more than 30 years’ experience practicing law, Matthew E. Mitchell, Esq., Senior Counsel in the Buffalo office of Tully Rinckey PLLC, focuses his practice on Civil Litigation, Corporate Law, Insurance Coverage, Land Use and Environmental Law, and Labor and Employment Law.

Prior to joining Tully Rinckey PLLC, Matt practiced in a range of capacities, including defending self-insured New York State public utilities in large-scale property damage claims for a Buffalo law firm. He focused on third-party contractual liability demands for defense and indemnity against licensees, subcontractors and their insurers and was responsible for all aspects of litigation from answer to mediation and settlement, including retention and supervision of expert witnesses to determine cause and origin, and common law damages. While with that same firm, Matt represented a prominent New York not-for-profit corporation in a bond transaction with a county development association to fund construction of a new state-of-the-art facility. He negotiated transactional documents with bond and bank counsel from inception to closing, and negotiated contracts with the general contractor and architect, including procurement of appropriate insurance policies with an emphasis on priority of coverage, as well as an IT agreement with an outside vendor for the design, operation, and maintenance of a learning management system.

Before moving back to Buffalo, Matt owned and operated a private law practice in Scituate, Massachusetts, where he represented applicants for coastal and inland wetlands and storm water permits under federal, state and local statutes and regulations, including appeals to the Superior Court, the Department of Environmental Protection, and the Massachusetts Court of Appeals. He worked closely with engineers and wetlands scientists throughout administrative proceedings and lawsuits, and advised clients concerning insurance coverage issues under property damage policies for flood losses.

Matt has also served as General Counsel for several companies in Massachusetts, including an automobile finance company, where he was responsible for contract, insurance coverage, litigation, corporate, bankruptcy, collection and employment matters, and a landfill capping and closure company , where he negotiated contracts with municipalities, site owners, and trucking companies, and assisted engineers and the shareholder with decisions concerning public outreach, government relations, capping strategies and general environmental law and regulatory compliance.

Prior to that, Matt was a Partner in the Litigation Department of a Boston law firm, where he handled environmental, corporate, insurance coverage, land use, employment, construction and public utility cases in Federal District Court and all State Courts.

Matt is admitted to practice in New York State; the Commonwealth of Massachusetts; the U.S. District Court, Massachusetts; and the U.S. Court of Appeals, 1st Circuit. He is a member of the Massachusetts, New York State, and Erie County Bar Associations, and the Western New York Trial Lawyers Association. He obtained his Juris Doctor and MSL, Magna Cum Laude, from Vermont Law School, and his Bachelor of Arts degree from the University of New Hampshire.
