Nicholas Devyatkin joined Tully Rinckey PLLC with experience in numerous areas of labor and employment law.
Since joining Tully Rinckey PLLC, Nicholas has expanded his skills representing employees and employers in federal, state and private employment law matters, including claims of discrimination, harassment, retaliation, whistleblower actions, prohibited personnel actions, disability retirement applications and disciplinary matters, and wage and hour litigation. Nicholas continues to help develop the firm’s labor law practice, representing unions, and all of their institutional needs, including unfair labor practice charges, collective bargaining negotiations, grievances and arbitrations. His work has included representation in New York State Courts, Federal District Courts, the Equal Employment Opportunity Commission, the Merit Systems Protection Board, the Federal Labor Relations Authority, the Federal Mediation and Conciliation Service, Federal Service Impasses Panel, and the National Labor Relations Board.
Nicholas also represents clients in the firm’s New York civil and commercial litigation and transactional practice, handling construction law issues, property disputes, contracts, shareholder agreements, mechanic’s liens, landlord-tenant issues and many other matters. Nicholas has experience in a variety of dispute resolution mechanisms including mediation, arbitration and court proceedings.
Prior to joining Tully Rinckey PLLC, Nicholas was general counsel for a well-known medical group based in Brooklyn, N.Y., where he advised on all of the company’s corporate matters. Nicholas developed an employee handbook for his medical group employer to comply with federal, state and city labor and employment laws. He drafted employment contracts, residential and commercial leases and other legally binding documents. He advised on Equal Employment Opportunity (EEO) compliance and personnel decisions, as well as health law compliance, including Stark, Anti-Kickback and HIPAA issues. Nicholas brings this knowledge to Tully Rinckey, handling denial of claims litigation and general health law compliance.
Nicholas received his juris doctor from American University Washington College of Law in Washington, D.C.
Representative Matters: Represented federal employees in disciplinary matters, ranging from letters of reprimand to suspensions and removals, disability retirement applications, federal employee EEO litigation through the informal, formal and litigation process; represented landlords and tenants in summary eviction proceedings, represented multiple clients in property damage and property dispute matters, assisted in private employee federal Title VII matter cases, lead attorney on pending private employment Fair Labor Standards Act matter, acted as counsel for federal employees Union and performed all institutional needs of Union, to include filing of unfair labor practices, grievances, arbitrations, contract negotiation and drafting; conducted depositions and paper discovery and drafting of dispositive motions in multiple plaintiff’s medical malpractice matters; represented successful medical provider in New York City and advised on matters regarding corporate formalities and corporate governance as well as labor and employment and healthcare law compliance, and drafted and reviewed commercial leasing and contracts with vendors, employees, and other corporations.
